Introduction - This contract is between yourself (referred to in the Terms & Conditions as "the customer") & Worthington Films and is activated once the Booking Fee (min deposit of £150 or another agreed amount) has been received. The booking fee is non-refundable after 14 days. You have 14 days from payment of the Booking Fee to cancel. In this case the Booking Fee will be refunded. The Product or Service is what is provided by Worthington Films to the Customer. These conditions do not affect your statutory rights.
Payment - For Wedding Videography Worthington Films may contact the Customer six weeks before filming to arrange full payment of the remaining balance. The remaining balance must be paid at this time and no later than 4 weeks before the wedding.
Cancellation - If the Customer cancels the order any monies paid to Worthington Films will be refunded to the Customer if 90 days or more notice is given. The Customer will forfeit the Booking Fee (deposit). If the Customer fails to give 90 days notice 50% of the monies paid to Worthington Films will be refunded to the Customer. The Customer will forfeit the Booking Fee (deposit).
Creative - Unless otherwise agreed, the Customer accepts the decision of Worthington Films on creativity within the Product(s) or Service(s). Every effort will be made to get the best possible position for the camera (s) but this is not always possible if restrictions are imposed.
a. Worthington Films cannot guarantee coverage of any particular individual/segment on the day. If a particular segment of the event is not recorded, partially recorded or not part of the final edited copy, it is at the sole discretion of Worthington Films.
b. Every effort it made to ensure perfect colour and lighting but certain conditions such as low light conditions, shadows, flashing lights may effect this. We make every effort to produce the best image possible.
c. Worthington Films consists of one videographer unless otherwise agreed with the Customer. Additional videographers can be arranged by Worthington Films if requested by the Customer 30 days in advanced. This will incur additional expenses for the Customer.
d. It is the Customer’s responsibility to obtain all permissions and consent required in order for filming to take place at the the venue/s and all locations.
e. Additional wedding footage may be purchased as one ‘extras’ video edit charged at £150. Raw individual files cannot be sent.
Health & Safety - Worthington Films & the Customer will act in accordance with all relevant health and safety requirements during filming and delivery of the product(s) or service(s).
a. The Customer(s) must seek permission from all venues where filming will be required.
Liability - Worthington Films accepts no liability for any loss or damage that may arise from the supply of the Product(s) or Service(s). In the unlikely event Worthington Films is unable to supply the Product(s) or Service(s) at all as agreed at the time of booking, liability shall be limited to the total invoice value or monies paid by the Customer. In this instance the Booking Fee will also be refunded to the Customer.
If a significant equipment malfunction results in Worthington Films only being able to provide some of the services to the Customer, the amount paid by the Customer shall be reduced accordingly to reflect the services provided.
Worthington Films accepts no liability for the loss or damage of footage and final films after delivery of all films. It is highly advised the Customer backs up their final films. Backing up of films is the sole responsibility of the Customer.
Copyright - Worthington Films retains copyright in all their original material.
Traveling Expenses - All packages include travel expenses up to 50 miles from Preston, Lancashire. For distances greater than this Worthington Films reserves the right to charge a fee for further motoring or rail expenses and local accommodation.
Marketing/Promotion - All Products/Services shall be used by Worthington Films for marketing and promotional purposes and may appear on YouTube, Social Media and www.worthingtonfilms.co.uk
Delivery - Completion is usually within 6-8 weeks from the date of the event (not including any bank holidays). This may be longer during peak season (May-September). Worthington Films will contact the Customer if a delay is expected.
The Customer will be provided with digital access to the Wedding Highlights Film prior to delivery of the USB. The Customer will be provided with ONE USB with all other agreed films on. Additional USBs can be ordered at £24.
Worthington Films keeps a copy of all Products for 6 months after completion. After this footage may be discarded.
Privacy - Worthington Films is committed to ensuring all customer data submitted to Worthington Films is protected under the General Data Protection Regulations and other data protection laws. Please review our Privacy Notice for further details.
It is the responsibility of the customer to ensure all event/wedding guests are aware that filming is taking place and their likeness and voice may be recorded and included in final video footage that may be used for Marketing purposes as mentioned above.
